Terms of Service

These Terms govern your use of Gubernator (the “Service”), operated by [Company / sole proprietor name] (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Gubernator is

Gubernator is a control panel that connects to servers you own or are authorised to manage and lets an AI assistant (Claude) and an AI agent (OpenClaw) run commands, edit files, and perform tasks on those servers on your instruction. You provide your own server credentials and your own Anthropic API key.

2. Eligibility & your account

• You must be at least 18 and able to form a binding contract.
• You are responsible for all activity under your account and for keeping your password secure.
• Provide accurate information and a working email; we may suspend accounts with false details.

3. Your servers and your responsibility for them

This is important. The Service executes commands on the servers you connect:

• You confirm you own or are explicitly authorised to administer every server you connect, and to run commands on it.
• Commands run via the Service can modify, delete, or destroy data, configuration, and services on your server. Some actions are irreversible.
• AI systems can make mistakes, misunderstand instructions, or behave unexpectedly. You review and approve actions before they run, and you accept responsibility for the outcome.
• You are responsible for your own backups. We strongly recommend backups before significant changes.

4. Third-party services

The Service relies on third parties you contract with directly, including Anthropic (Claude API — your chat content and relevant context are sent to Anthropic to generate responses), your server/hosting provider, and our payment processor. Your use of those services is subject to their terms, and you are responsible for any fees they charge (for example, Anthropic API usage billed to your key).

5. Acceptable use

You must follow our Acceptable Use Policy. In particular, you must not use the Service to access or attack systems you are not authorised to manage, or for any unlawful purpose.

6. Subscriptions, billing & refunds

• Paid plans are billed in advance on a recurring basis via our payment processor (PayPal).
• Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period.
• Except where required by law, fees are non-refundable. Any free trial converts to a paid plan unless cancelled before it ends.
• We may change pricing with reasonable notice; changes apply from your next billing cycle.

7. Suspension & termination

We may suspend or terminate accounts that breach these Terms, pose a security risk, or are used unlawfully. You may stop using the Service and delete your account at any time from Settings, which removes your stored data as described in the Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Service, the AI, or any command will be error-free, uninterrupted, or produce a particular result.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, revenue, or business, arising from your use of the Service — including damage to or loss of data on your servers, downtime, or third-party fees. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your servers, your content, or your breach of these Terms or applicable law.

11. Changes

We may update these Terms. Material changes will be notified by email or in-app. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of South Africa, and you submit to the non-exclusive jurisdiction of its courts.
